Terms and Conditions for Hypernova Media’s Free Website Competition

1. Eligibility 1.1. The competition is open to businesses located in Bedfordview, South Africa. 1.2. Entrants must be 18 years or older and authorized to represent the business they are entering into the competition. 1.3. Employees of Hypernova Media, their immediate family members, and affiliated partners are not eligible to enter.

2. Entry Requirements 2.1. To enter, participants must complete all required steps outlined in the Call to Action, including following Hypernova Media on specified platforms, sharing the competition post, tagging other businesses, and submitting the entry form. 2.2. Only one entry per business is permitted. 2.3. Incomplete entries or entries received after the closing date will be disqualified.

3. Prize Details 3.1. The prize includes the design and development of a non-ecommerce website of up to 10 pages, with:

  • 6 months of free hosting.
  • 3 business email addresses.
  • Use of stock images and footage provided by Hypernova Media.
  • Up to 20 hours of website development. 3.2. Any additional work beyond the specified scope, such as extra pages, advanced functionalities, or custom features, will incur standard charges at the winner’s expense. 3.3. The prize does not include domain registration fees, hosting beyond the initial 6 months, or custom imagery and video.

4. Project Timeline 4.1. The website will be developed and published within 4 months of the winner’s announcement, contingent upon the winner providing all necessary materials and feedback promptly. 4.2. Delays caused by the winner’s failure to provide required content or feedback may result in extended timelines or forfeiture of the prize.

5. Content and Material Submission 5.1. The winner is responsible for providing all required content, including text, images, and logos, within 14 days of the project start date. 5.2. Hypernova Media reserves the right to refuse any content that violates copyright laws or is deemed inappropriate or offensive.

6. Publicity and Portfolio Rights 6.1. By entering the competition, participants agree to allow Hypernova Media to announce the winner’s name and business in promotional materials. 6.2. The completed website may be showcased in Hypernova Media’s portfolio and used in marketing campaigns.

7. General Terms 7.1. The prize is non-transferable and cannot be exchanged for cash or other services. 7.2. Hypernova Media reserves the right to modify or cancel the competition at any time without prior notice. 7.3. Any disputes arising from the competition will be resolved at the sole discretion of Hypernova Media.

8. Intellectual Property 8.1. All intellectual property rights of the completed website will belong to the winner upon final delivery, excluding any third-party assets or tools used. 8.2. Hypernova Media retains the right to use the website design in promotional and portfolio materials.

9. Exclusions and Limitations 9.1. The website will not include e-commerce functionalities, advanced integrations, or custom coding unless explicitly agreed upon at an additional cost. 9.2. The free hosting service is limited to the initial 6-month period. After this, the winner will be responsible for renewing hosting services.

10. Website Registration and Transfer 10.1. During the initial 6-month hosting period, the website will be registered under Hypernova Media. 10.2. Upon successful completion of the 6-month period and fulfillment of all obligations by both parties, the website will be transferred to the winner’s account. 10.3. After the transfer, the winner will assume full responsibility for domain registration, hosting, and any related account billing.

11. Acceptance of Terms 11.1. By entering the competition, participants agree to these terms and conditions in full. 11.2. Hypernova Media reserves the right to disqualify any participant who breaches these terms or acts in a manner that could harm the reputation of Hypernova Media.

12. Winner Selection and Notification 12.1. The winner will be selected based on the discretion of Hypernova Media, considering the entry form responses. 12.2. The winner will be notified via email or phone within 7 days after the competition closing date. 12.3. If the winner does not respond within 5 business days, an alternative winner may be selected.

13. Liability 13.1. Hypernova Media accepts no responsibility for entries not received due to technical issues or other unforeseen circumstances. 13.2. Hypernova Media will not be held liable for any damages, loss of business, or other issues resulting from the use of the website.

14. Data Protection 14.1. Any personal information collected during the competition will be used solely for the purpose of administering the competition and will not be shared with third parties. 14.2. Participants consent to the use of their data in accordance with Hypernova Media’s privacy policy.
